The rules that apply when you book a shipment with us.
1. These terms
These conditions apply to every quotation, booking and shipment handled by Mogadishu Shipping & Cargo LLC. By accepting a quote or handing us cargo, you accept them.
2. What we are
We act as a freight forwarder and customs clearing agent. Unless we say otherwise in writing, we arrange transport on your behalf rather than performing it ourselves as the carrier.
3. Quotations
- A quote is valid for 14 days unless it says otherwise.
- Quotes are based on the weight, volume and description you give us. If the real cargo differs, the price changes.
- Duty figures are our best estimate. The final amount is set by customs, not by us.
- Carrier surcharges outside our control, such as fuel or war-risk charges, may be added and will be shown to you.
4. Your responsibilities
- Describe the cargo honestly and completely, including anything dangerous.
- Provide correct commercial invoices, packing lists and licences on time.
- Pack and mark the goods well enough to survive normal handling.
- Make sure the goods are legal to export from the origin and to import into Somalia.
If a wrong or missing declaration causes a fine, delay or seizure, the cost falls on you.
5. Goods we will not carry
We do not accept weapons, ammunition, explosives, narcotics, counterfeit goods, ivory, human remains, or anything banned under Somali law or the law of the origin country. Some dangerous goods can be carried with the correct declarations, but only if agreed in writing before booking.
6. Payment
- Unless a credit account has been agreed, freight is payable before the cargo is released.
- Duty, port charges and storage are payable as they fall due.
- We may hold cargo against unpaid amounts owed to us on that shipment or any other.
7. Delivery times
Transit times we publish or quote are estimates based on normal conditions. Weather, port congestion, customs inspection, security incidents and carrier schedule changes can delay a shipment. We are not liable for loss caused by delay unless we agreed a guaranteed date in writing.
8. Liability
- Our liability for loss or damage is limited to the terms of the carrier's contract and the international conventions that apply to that leg of the journey.
- We are not liable for indirect losses such as lost profit, lost contracts or market loss.
- We are not liable for damage caused by poor packing, inherent defects in the goods, or events outside our reasonable control.
9. Insurance
Carrier liability is limited and is not insurance. We strongly recommend marine cargo insurance for valuable shipments. We can arrange it, but only if you ask for it in writing before the cargo is loaded.
10. Claims
Tell us about visible loss or damage at the moment of delivery, and note it on the delivery document. Any other claim must reach us in writing within 14 days of delivery, with supporting photographs and documents.
11. Storage and demurrage
Free storage days are set by the port or the carrier, not by us. Once they run out, demurrage and detention charges apply and are passed to you at cost. Collect your cargo promptly.
12. Cancellation
You may cancel a booking before the cargo is loaded. Costs already committed to carriers or agents on your behalf remain payable.
13. Governing law
These terms are governed by the laws of the Federal Republic of Somalia. Disputes will be settled in the courts of Mogadishu unless both sides agree to arbitration.
14. Changes
We may update these terms. The version published on this page on the day you book is the version that applies to that booking.
